Terms of Service

“Thumb Butte Web” is a trade name used by BENED LLC, an Arizona limited liability company (“BENED,” “we,” “us”). Any website, hosting, or related service purchased through work.bened.works or in person is a contract with BENED LLC.

Fixed-price website builds for family-owned and independently owned businesses in and around Prescott, Arizona, plus an optional ongoing hosting and care service (the “Care Plan”). No project begins until you’ve received and accepted a written, itemized proposal.

Every project starts with a written proposal listing exactly what’s included and the total price.

A deposit stated in your proposal is due before work begins; the remaining balance is due at handover, before the site is made public, unless your proposal says otherwise.

Payment is made to BENED LLC, by the method stated on your invoice.

The price is fixed for the scope described in your proposal. Anything not listed there is additional work, quoted and agreed to separately before it starts.

Before work begins: any deposit paid is refunded in full.

After work begins: the deposit is earned and non-refundable, reflecting time and materials already committed. Any payment beyond the deposit is refunded on a pro-rated basis for work not yet completed.

We may decline or discontinue a project at our discretion — for example, if it would involve illegal, hateful, or fraudulent content. In that case, anything paid beyond work actually completed is refunded.

Until the full price is paid, BENED LLC retains ownership of the website, its code, and its design.

Once payment is received in full, ownership of the completed website — code, the content you provided, and its configuration — transfers to you. You may host it anywhere, modify it, or hire anyone else to work on it.

You keep ownership of anything you give us — photos, logos, text, business information — at all times, and you confirm you have the right to give it to us and to have it used on your site.

We may keep and reuse general techniques and non-confidential code patterns, and, unless you ask us not to, may reference your finished site and business name as an example of our work.

The Care Plan is billed annually and is optional — it is never required to receive or keep your completed website.

You may cancel it at any time. On cancellation, you receive a complete, working copy of your site — code, content, and a plain guide to moving it — that runs with no BENED service required.

If the Care Plan lapses without cancellation — a missed payment, for instance — we’ll make reasonable efforts to reach you before the site goes offline, but are not responsible for downtime after a lapse.

We don’t guarantee any specific business outcome — sales, traffic, or search ranking. A good website is one input into a business’s success, not a guarantee of it.

We’re not responsible for third-party services your site may connect to — Google, payment processors, review platforms — or for their availability, pricing, or policies.

To the extent Arizona law allows, our total liability for any claim related to our services is limited to the amount you paid us for the specific project the claim relates to. We are not liable for indirect, incidental, or consequential damages.

You’re responsible for making sure any content, images, or information you give us doesn’t infringe anyone else’s rights and is lawful. We may decline to build or continue building anything illegal, infringing, or that we reasonably believe exposes us to legal risk.

When you type your name — and, where your project uses it, confirm with your account PIN — to accept a proposal through this portal, that is your electronic signature, with the same legal effect as a signature on paper under Arizona’s Uniform Electronic Transactions Act.

These terms, and any project agreement, are governed by the laws of the State of Arizona. Disputes are handled in the courts of Yavapai County, Arizona.

We may update these terms as the business grows. If we do, the new version is posted here with a new effective date. For a project already underway, the terms in effect when you accepted your proposal continue to apply to that project.
